Terms of Service
This agreement contains the entire understanding between Rachael Amos Photography and The Client (the couple). It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties. There is no need to print this document as you can sign your agreement using the contact form at the bottom.
CHANGE OF DATE OR VENUE
Rachael Amos Photography must be notified of any changes in schedule or location, at least 2 months prior to the scheduled date of event. Notification of any changes can be made via email. Changing your wedding date is subject to the availability of that date, and shall not incur any extra costs. In the event of change of address or contact information as listed, you must notify Rachael Amos Photography within 7 days of the change.
DEPOSIT
A retainer fee of £50 is required to hold the date of your wedding. No date is reserved until a retainer is received. An Act of God may warrant cancellation of the wedding day, in which event a refund of the deposit amount will be refunded at Rachael Amos Photography's discretion. In all other events, the refund is non-refundable. The balance of the complete package price must be paid 30 days before the date of the wedding. If final payment is not received as set forth herein, Rachael Amos Photography reserves the right to not attend the wedding. Upon payment of the retainer fee, Rachael Amos Photography agrees to reserve the date and time specified. The retainer fee is applied towards the final contracted wedding package and is not in addition to the package chosen.
CANCELLATION
Once the full balance is paid, it is NON-REFUNDABLE. Any other arrangements shall be discussed between the client and Rachael Amos Photography. All arrangements will be put in writing. Cancellation must be in writing, even if a phone call was made to inform Rachael Amos Photography of the cancellation. The retainer fee will be transferable to a new date up to 365 days after cancellation. The client will be given the chance to reschedule but cannot be pushed ahead of other reserved clients. No fees will apply for rescheduling.
FAILURE TO PERFORM
Due to the limited and subjective nature of weddings, Rachael Amos Photography cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the church or location restrictions. The photographer is not responsible for lost photo opportunities due to any kind of equipment malfunction, the lateness of the event couple, or other principles. The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications of individuals, rules and restrictions of venue, or the rendering of decorations of the location. It is acknowledged that any lists submitted to Rachael Amos Photography will be used for organizational purposes only and in no way represents photography that will actually be produced although every effort will be made to follow it. Rachael Amos Photography will do their best to fulfil all requests but can make no guarantees all images will be delivered.
UNFORESEEN CIRCUMSTANCES CLAUSE
If Rachael Amos Photography, cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then Rachael Amos Photography shall return any moneys paid by the client, but shall have no further liability with respect to the agreement. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, compact flash card malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Rachael Amos Photography. If Rachael Amos Photography is unable to attend the wedding due to illness, every effort shall be made to arrange a suitable replacement. If a replacement cannot be found, Rachael Amos Photography will provide a full refund of any monies paid and their obligation shall be limited to this refund.
LIABILITY
Rachael Amos Photography holds full public liability insurance and a copy of policy can be made available to client/venue if desired. The Client is advised to ensure the safe behaviour of all guests during photo shoots.
SECOND SHOOTER
If a second shooter is selected for the event and added to the contract, they will be there for the hours chosen by the photographer. Second shooters may not be there for the entire day depending on the needs of the photographer that day. Clients must give discretion to Rachael Amos Photography on this matter. All other clauses stated in this document cover both photographers.
VENUE VISIT
Two months prior to the wedding date, Rachael Amos Photography will invite the client to a venue visit, please respond to this invitation in a timely manner. The client will be responsible for identifying people/objects of whom/which specific photographs are desired at the wedding and reception; these will be discussed at the venue visit. The client is also responsible for identifying any individuals that do not desire to be photographed, or any medical issues that may arise (e.g. guests with epilepsy who may adversely suffer from repeated flashes). This information needs to be provided no less than one month before the wedding day.
PERMISSIONS
It is The Clients’ responsibility to schedule and receive permission to use various locations for photography, including the wedding and reception locations and any other locations used during the day. The use of smoke grenades or sparklers must be pre-approved in writing by the venue.
EXTRA HOURS
Rachael Amos Photography will arrive earlier or stay later on the wedding day at The Clients' descretion. Extra hours can be booked for £25 per hour. If extra hours are needed on the day, the payment will be due no less than 30 days after the wedding date. Failure to provide this payment could result in The Photographer's withholding of images until payment is received.
RECEIVING IMAGES
Images will be ready to deliver within 8 weeks of the wedding date. In peak times, May - September, 12 weeks should be expected to allow for other weddings in the queue. Weddings will always be edited the order in which they were attended, and the final product shall be submitted to The Client in the same manner. Images will be delivered on a wooden USB and any prints or products ordered will be delivered shortly after. After selecting photos for canvas pictures, these will be delivered within 2 weeks. After selecting images for the album, the finished product will arrive within 2 months. Rachael will provide a preview of the album for proof before submitting for publication.
COPYRIGHTS
All photos created by Rachael Amos Photography are copyright protected. It is a violation of federal copyright law to copy, scan, or allow photographs created by Rachael Amos Photography to be duplicated, digitally reproduced, copied, scanned, or altered digitally or otherwise, without Rachael Amos Photography's express written permission. The negatives/digital files remain sole property of Rachael Amos Photography and will never be given or sold. Rachael Amos Photography agrees to grant image rights to the client with a non-exclusive, limited, perpetual license. This license allows the client to do the following with the images: i) Display the images; ii) Print the images; iii) Upload, email, or electronically transfer the images or files; and, iv) Publish the images on personal websites or social media websites. THIS LICENSE WILL PROHIBIT THE CLIENT FROM DOING THE FOLLOWING: APPLYING FOR COPYRIGHT REGISTRATION OR SELLING OF ANY IMAGE OR ELECTRONIC FILES SUPPLIED BY RACHAEL AMOS PHOTOGRAPHY, MAKING ‘DERIVATIVE WORKS’ OR OTHERWISE MODIFY, INCLUDING EDITING AND/OR MANIPULATING ELECTRONIC FILES.
EXPENSE REIMBURSEMENTS
Rachael Amos Photography does NOT expect reimbursement for expenses relating directly to the wedding event. For example, parking fees, destination travel fees, hotel fees accommodations, etc. Weddings outside of a 120 mile radius of Plymouth will require an additional fuel cost, calculated at 45p per mile. Rachael Amos Photography will add any relevant charges to The Client's invoice.
GARMENTS
Rachael Amos Photography cannot be held responsible for damage to garments during photo shoots. The Client is responsible to arrange personal assistance for wedding garments. Rachael Amos Photography will not put any parties in a situation (unless requested by bride or groom) that will cause harm or damage to special garments. In the event that smoke grenades are booked for photographic purposes, The Client agrees that there is a very small chance of staining of white materials and that Rachael Amos Photography will not be responsible for providing replacements or reimbursements of said items.
CREATIVE FREEDOM
Images may be edited at the photographer’s discretion, and delivered images will not include all images shot. The Photographer reserves the creative right to edit and release only those deemed professional in quality and adhering to The Photographer’s artistic standards. By signing this contract, the client is aware of the style of photography that Rachael Amos Photography produces. Unedited images will never be sent out, and The Photographer will choose which of the images taken will constitute the final package sent to The Client.
RETOUCHING
Retouching will be performed on all images individually. This includes global adjustments (white balance, colour correction, exposure, contrast, clarity), skin and beauty retouching and any other things seen to be fixed by The Photographer e.g. removal of Fire Exit signs. What classifies in this category falls under The Photographer's discretion. Any additional retouching will incur an extra charge if The Client requests extra editing after receiving the final images. Each photograph will incur a cost of £5 for extra retouching.
SUBSTITUTION
In the event of illness or sudden event out of the control of both parties, Rachael Amos Photography will attempt to substitute a photographer at no cost to The Client. This contract will be transferable to said photographer. This photographer will shoot the event and Rachael Amos Photography will make every attempt to edit the selected files for The Client.
TERMS/CONDITIONS
Offerings [excluding prices] are subject to change without notice. The most up to date contract will immediately apply to any client that has already signed.
STORAGE OF IMAGES
Rachael Amos Photography recommends backing up the final images on another media format after receiving digital files. It is The Clients' responsibility to keep several copies of any digital or hard copies of the images in more than one location, and back the images up on another format such as a hard drive. Once the images have been received by The Client, it is The Clients' responsibility to download and save the images. Rachael Amos Photography will keep all final delivered images on the her computer for one year only after the wedding date.
THE UNDERSIGNED HEREBY ACKNOWLEDGE THAT THEY HAVE RECEIVED, READ, AND UNDERSTAND THIS AGREEMENT’S CONTENTS. Permission is hereby granted to Rachael Amos Photography to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose. If you would like to request exceptions to this release, please inform Rachael Amos Photography via email or in writing via post. All parties understand and agree to all that is above. Client(s) agree(s) to only sign if they have read and agreed to the terms of service in this contract and they believe all information is deemed correct to the best of their knowledge.
